RESERVATIONS - TERMS & CONDITIONS

All guests enter a binding and legal contract with Southern Select Villas (SSV) and their affiliates when ordering or placing a reservation with SSV through the online/phone reservation system. All reservations made with SSV are final if and only if the reservation has been confirmed by SSV and the down payment deposit has been collected by SSV. Payment of the deposit by the Guest constitutes an acceptance of all the Terms & Conditions stated below. It is the guest’s obligation to verify the confirmation for accuracy of the reservation and all information on the reservation. SSV must be notified of all discrepancies within 24 hours of receiving confirmation of the reservation. Only the guests named on the booking form, or by letter, or by email are permitted to stay in the Villa. Subletting, sharing or assigning the reservation is strictly prohibited. For our records, we require a copy of the lead Guest’s legal Photo ID – must match the credit card user.

PAYMENT: A deposit of 20% of total balance is required to confirm your dates and secure your accommodation.

  • The reservation is not confirmed until your deposit is received, and confirmation of reservation has been sent to guest.
  • The balance is due 45 days prior to arrival (or earlier).
  • We will send out final instructions including check-in details, approximately 72 hours prior to your arrival date.
  • Bookings made within 8 weeks of the arrival date must be paid in full.
  • Payments must be made in US Dollars ($). SSV accepts Visa, Master Card, Discover and American Express or any debit cards with those logos. Cashier’s checks and personal checks are acceptable if SSV is notified in advance and check is received 90 days prior to your arrival date.
  • Any bank fees such as returned check fees or foreign currency exchange fees will be paid by guest.
  • The guest acknowledges, approves, and gives SSV the consent to charge the credit card provided for the remaining balance of the reservation amount upon the final payment due date.
  • SSV will not release the property information or entry details to the property prior to receipt by SSV of payment in full and completed booking form.
  • SSV reserves the right to cancel the booking if you do not comply with the booking procedure and payment terms.
  • Cancellation of the arrangement due to non-payment of the balance by the due date will result in loss of all monies.


Rates: SSV reserves the right to amend rates at any times. Pre-existing reservations, where the Guest has made a payment, will remain at the pre-increase pricing.

Processing/Admin Charge: A $25 processing/admin fee is charged for every reservation to cover the cost of administrative documents and management services.

CHECK IN / CHECK OUT: Check in time is any time after 4:00 PM on the day of the arrival. Check Out time is 10:00 AM on the day of departure. Failure to depart by this time will incur a charge equal to one day’s rental.

  • Guest is hereby granted a license to use the premises. The Guest acknowledge and agrees that no form of tenancy has been created pursuant to Chapter 83, Florida Statues through Guest’s use of the premises.
  • If a key was provided to guest in a lock box, its needs to be returned before departure. If key is lost, damaged, or broken, the Guest of record accepts financial responsibility for locksmith charges and applicable replacement costs.
  • No refunds will be given for late arrivals, early departures, or any unused days. Under no circumstances can the security deposit be refunded on day of departure.


Early Check In/ Late Check Out: Early Check in and Late Check Out can be requested 72 hours prior to guest arrival for an additional fee and is subject to SSV approval. SSV does not guarantee Early Check In and/or Late Check Out.

ACCIDENTAL PROPERTY PROTECTION PLAN (APPP): The property protection plan is a non-refundable fee of $79 that covers up to $500 for accidental damage or breakage that may be caused to the property or its contents during the Guest’s stay. At no time should any of the inventory items be removed from the property.

  • The APPP fee will cover reported accidental or inadvertent damage, which must be reported to SSV within 24 hours in order to be eligible for coverage.
  • Accidental Property Protection Plan is non- refundable.
  • The APPP does NOT cover intentional damage, theft, excessive cleaning, and unintentional/incidental damage over amount of coverage purchased or any damage.
  • The Guest of Record hereby authorizes Southern Select Villas to charge the Guest of Record’s credit card to cover vandalism, intentional damage, gross negligence, missing items and/or willful and wanton conduct not covered under the APPP.
  • ****A valid credit card must be provided in addition to the non-refundable fee****
  • This plan is provided by and administrated by Southern Select Villas and is not an insurance policy.
  • If Guest decides not to purchase the APPP, Southern Select Villas reserves the right to charge the guest’s credit card a $500 security deposit. The security deposit will be credited when guests leave, inspection report is completed and there is no damage reported. Some owners will have a mandatory APPP and cannot be waived.
  • APPP does NOT cover bedding and linens.

CANCELLATION: The guest may cancel their booking at any time up to or during the Rental Period in writing (email, fax or posted mail). In the event that the Guest exercises their right to cancel, SSV will levy the following cancellation penalty percentage rates of the Total Rental Fee including deposit:

  • Within 48 hours of booking -Free cancellation
  • From initial date of booking up to 46 days prior to the arrival date – loss of deposit
  • Within 45 days of arrival – No refund

SSV regrets that it is unable to waive any cancellation charges above, whatever the circumstances. If payments are made by a credit card and subsequently cancelled, a 5% credit card commission charge will be made. No cash refunds are given.

CHANGE IN BOOKING: When guest chooses to amend their booking 30 days or more prior to arrival, resulting in a change in the property size or location, or a change of dates of stay, a $50 Booking Administration Fee will be levied in addition to fees associated with the requested changes. Any changes to existing bookings within 30 days of arrival will not normally be permitted, but we will try to accommodate where we can.

GENERAL - TERMS & CONDITIONS

Self-Catering: Each home comes with a fully equipped kitchen including a refrigerator with freezer, oven, dishwasher, toaster, coffee maker, cookware, dishes, glasses, utensils, linens, and towels. Each property also includes a full-size washer and dryer, iron, ironing board, and hairdryer. While bath and hand towels are provided, you may want to bring your own pool towels and washcloths, as they are not always supplied in the property. SSV provides a complimentary starter soap, toilet paper, and a trash bag. Once these items are used, it is the guest responsibility to replenish them.

Trash: Trash pickup is posted in the vacation home. Trash must be in a sealed trash bag and placed in the bin and moved to the end of the driveway on the day scheduled for pick up or in benches in front of property as described in Guest Information book or as posted in the Villa. Trash must be removed from inside the home at departure and put in sealed trash bags. $100 will be deducted from your security deposit for excess trash removal after your departure.

Maximum Occupancy: Is strictly enforced according to Florida Statues. There shall be no more than the maximum number of guests allowed by law. If our team finds that you have more than the maximum occupancy at the property, we will require you to vacate the property without refund. This includes family and friends visiting. Also, the lead guest on the reservation must be staying in the property for the entire stay. If the lead guest is not staying in the home, this makes the reservation void and the group must leave the home without a refund.

Age of Guest: Guest of Record must be a minimum of 21 years of age. It is SSV’s policy that all children under the age of 18 are not left in the property un-supervised during the rental period. The Guest must ensure that children are always supervised.

Optional Travel Insurance: We strongly recommend that you take out travel and medical vacation/holiday insurance to cover yourself in the event it is necessary to cancel your vacation/holiday. Hurricane/Tropical Occurrences: SSV does not offer refunds or reschedule booking due to hurricane activity. If you are concerned about the possible interruption, cancellation or delayed travel due to tropical occurrence, you are strongly encouraged to purchase travel insurance at the time of booking. Typically, peak season for tropical activity is August through October.

Guest Information: Each property is provided with a guest information book or plaque which will contain both general and specific information relevant to both the property and surrounding area.

Use of Property: Normal usage of electricity and water are included in the rental price. Please keep all sliding glass doors, pool doors, front and back doors, entrance doors, and all windows closed while the air conditioner is on. Any misuse of the property’s system resulting in costs being incurred will be reimbursed by the lead guest. This includes but not limited to:

  • Air conditioning: Must not be set below 72F as freezing the unit can occur. A minimum call out charge is currently $125.
  • Disturbance: All communities have a noise ordinance after 10:00 PM. Guest of record shall not create a noise or disturbance that will annoy the surrounding property owners. Creating a disturbance shall be grounds for immediate termination of this agreement and guests shall immediately vacate the property.
  • Pools: All swimming pools are used entirely at the Guest’s “OWN RISK”. No diving is allowed, and children must always be supervised. Glass is not permitted in the pool area at any time. According to Chapter 515:33 of the Residential Pool Safety Act: Anyone tampering with or disconnecting of pool alarms commits a misdemeanor of the second degree, punishable by a $5,000 fine or (1) year in jail. Please do not tamper with the pool alarms. Pool heater, actuators, pool valve or pool equipment must not be tampered with. Should the Management Company find that any pool controls have been adjusted, the Guest will reimburse SSV/Owner for the full cost of repairs any/or increase in the utility bill.
  • Pool Cage & Screens: Do not bounce balls in the pool area. This may tear, rip or damage the screen/netting or break the outside lights; you will be responsible for all damages. After check out inspection if excessive cleaning is required – you may be billed.
  • Pool Heat: Not all pools have heaters, to ensure a heater is available it should be booked at time of the reservation. The pool will only heat approximately 10-15 degrees above the outside temperature during the cold months. If the temperature falls below 55 degrees, the heating unit will not heat the pool and may shut down as a result. This is a built-in safety feature and cannot be overridden. There are no refunds due to the inability of a pool heater to heat the pool water during the cold months. Pool heating charges start on the day your pool heating is turned on; your arrival day. It will take approximately 24 hours for the pool to heat fully.
  • Spa: If the property has a spa, you must purchase heat for it to be warmed. The spa can only be heated by the pool heater. If you purchase pool heat, the pool and the spa can only be heated to the same temperature, as the spa is not a stand-alone hot tub or jacuzzi.
  • Toilets/Water Closet: Do Not flush paper towels, feminine items or diapers down the toilet. There is a plunger in the house if needed. If there is a problem, call the office immediately. If maintenance determines the plugged toilet is a result of excess toilet paper or any of the “do not flush” items above, you will be charged a minimum of $125 for a call out fee to unplug the toilet.

Safety: The guest shall see to their own security while in the property by arming the alarm (if applicable), locking doors, windows, garage doors, when it’s prudent to do so.

Smoking: For the comfort and safety of guests, the villas are designated as non-smoking. Failure to observe these rules will result in a minimum of $350 charge to cover the cost of sanitizing the property.

Animals and Pets: Regrettably, animals and pets are not permitted in most properties except for service animals as required by law in compliance with the Americans with Disabilities Act. The unauthorized occupancy of pets where prohibited will result in an immediate eviction and loss of all rents and security deposits. A minimum cleaning fee of $350 plus tax will be assessed to any guest violating the pet policy to cover the extra costs for sanitizing the property. If the home reserved is pet friendly, the Guest of Record will need to pay an additional and non-refundable Pet Fee in the amount of $150.00 (per pet), limit 2 unless otherwise noted.

Underage Drinking: Is not allowed and will not be tolerated and is grounds for immediate eviction without refund. If this occurs, we will notify the local authorities and guests will be subject to all local county and/or state laws pertaining to this violation.

Parking: Please be aware that parking of RV’s, campers, boats, and trailers in the driveway of the home or anywhere in the development is not permitted by the local Homeowners Association.

Pest Control: Florida is a sub-tropical climate and that unwanted pests, both inside and outside of the property are a common occurrence. All properties are serviced on a regular basis, however, from time to time, additional services may be required. If additional services are required, the guest must report the issue with the emergency number provided and someone will resolve the issue as soon as possible. SSV cannot guarantee the total absence of insects or pest but will take action when deemed necessary by SSV. SSV will not be held accountable for such occurrence and no refund or compensation will be provided. If pest problem is found to be caused by Guest’s negligence, any costs incurred for additional pest control and/or cleaning may be passed on to the Guest.

Pre- Arrival Inspection: Prior to each Guest’s arrival, a home inspection is performed to ensure the home is neat and tidy, with major appliances and utilities in functioning order. Any maintenance items found to need repair or not functioning properly will be scheduled for a maintenance work order by our team. While we attempt to rectify these issues prior to Guest’s arrival, it is not always possible, and the work order will be scheduled for completion after your stay. If the guest wishes to report something regarding the home, please call our office to schedule a work order.

Amenities: SSV makes no guarantee that the HOA/Community operated amenities will be available.

Rental Equipment: Grills, cribs, strollers, adult mobility scooter or something else? Let us know and we can make arrangements for you. Guests are not allowed to bring their own grill if it is not a gas grill. Charcoal grills are a fire hazard and SSV will not be held responsible.

Owner’s closet: If applicable, even if unlocked, the guest of record agrees not to access the owner’s closet, which may contain cleaning supplies and chemicals that could be hazardous to children and adults.

Smoke Detectors: The property has smoke detectors installed and are believed to function properly at the time of rental. The guest will notify management without delay if a fire alarm “chirp” or has a low battery condition. Should smoke detectors found to be removed or damaged, the Guest of record will be charged $150.00 for tampering with safety equipment. The guest is advised that there may be no carbon monoxide detector on property and accepts the risk involved in not having one.

Lost and Found: If any items are left behind, the item will be held for the guest and every reasonable effort will be made to contact the guest for return. The cost for the item to be returned will be solely the cost of the Guest. If items are not claimed within 30 days of departure, they shall become the property of Southern Select Villas. SSV shall not be held liable for condition of said property.

SERVICE LEVEL

Southern Select Villas agrees to a Service Level for the remedy of any problems found at the property, either on arrival of the guest or during the rental period as follows. SSV makes all reasonable efforts to maintain each property and its equipment in good working order. Wherever commercially possible, repairs are performed within 24 hours, but sometimes delays are inevitable.

Any problems that arise during the rental period that does not constitute as an emergency, as determined by SSV, will be remedied during or after the Rental period, based on the severity of the problem and at the sole discretion of SSV.

No refunds are granted for malfunctioning mechanical or electrical equipment including (but not limited to) inoperable appliances, air-conditioning, pools and or/spas. No refunds will be given for unfavorable weather, early departure, utility service interruption, construction, or maintenance issues. Additionally, there are no refunds for faulty recording or playback equipment, TV’s, internet access, audio, telecoms, cable reception, or computer equipment.

SSV or their representatives may enter the property at any time, without notice, for the purpose of protection and/or maintenance of the property. Whenever possible, SSV will provide notice to the guest prior to such entrance.

Any problems regarding the vacation home should be directed to our office. The phone number is 863-420-1488. Our business hours are 9:00 AM to 5:00 PM Monday through Friday. Weekends and evenings are emergencies only. If due to the fault of the guest, and at the discretion of SSV, there could be a service fee applied anytime SSV is called out to the property.

All vacation rentals are licensed and regulated by Hotel/Motel Registration Law and fire department guidelines and restrictions.

Complaints or Dissatisfaction: In the unlikely event of a complaint during the Guest’s stay, please contact Southern Select Villa immediately. 863-420-1488 or info@southernselectvillas.com . If the problem has not been reported to SSV, we cannot fix the issue and cannot accept any responsibility.

Right to Refuse Service: The rental property is privately owned and managed. Southern Select Villas/ Owner reserves the right to refuse service to anyone.

Charge Backs: No charge backs will be levied against any payments made in settlement of the agreed rental made with a credit card transaction as deposit, balance or full payment after the departure date.

Cancellation by Southern Select Villas (the company): In the event the rental property becomes no longer available through unforeseen damage or circumstances beyond the company’s control, we will try to offer similar or superior standard within our available inventory. If guest does not wish to accept the alternative property, or an alternative property is not available, the booking may be cancelled without penalty and we will refund any monies paid (without interest, compensation or consequential loss of any kind) and will constitute the limit of the company’s liability.

Disclaimer of LIABILITY: The property is privately owned and neither the owners, management company or booking company, accept any responsibility whatsoever for personal injury, accidents, loss or damage to persons or personal effects, however caused, including surrounding construction work, excessive disturbance of neighboring properties, failure of utility supplies such as water, electricity, gas or air conditioning, acts of God, acts of violence, nature, fire, war, civil disobedience, riot, or other Force Majeure that may have an adverse effect on the guest. Although, we will make every effort to respond and minimize any disruption caused during the rental period.

Accuracy of Information: While all information supplied is deemed to be correct, and to the best of our knowledge, it is understood that the information supplies is for guidance purposes only and does not form part of any contract. No liability will be accepted in the event of any error.

The Guest of Record agrees to defend and indemnify Southern Select Villas, Owners, its Affiliates, and/or their respective suppliers and any of their officers, directors, employees and agents against any claims, cause of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:

  • Your breach of this Agreement or the documents referenced herein.
  • Your violation of any law or the rights of a third party; or
  • Your use of this Website.

Extra Services: Any issues arising from the use of extra services provided by the designated Management Company should be dealt with directly with said company. The SSV/Owner accepts no responsibility for any independent arrangement whatsoever between the guest and the designated company.

Enforcement of Agreement: Guest of Record agrees to pay all reasonable costs, attorney fees, and expenses that shall be made and incurred enforcing this agreement and are subject to Florida Law and the exclusive jurisdiction of the Florida Courts and Orange County.

 

Southern Select Villas reserves the right to reasonably amend any of the terms and conditions set out herewith.
